Welcome to BWChat. These Terms of Service ("Terms") govern your use of the BWChat mobile application and related services (collectively, the "Service") operated by Junpei Namiki (並木惇平, sole proprietor), doing business as BWChat ("we", "our", or "us"), based in Tokyo, Japan, and available through www.id7.com.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service. For detailed business and transaction disclosures required under Japanese law, please refer to our 特定商取引法に基づく表記.

1. Eligibility

You must be at least 13 years old to use BWChat. By using the Service, you represent and warrant that you meet this age requirement. If you are under 18, you represent that you have your parent's or guardian's permission to use the Service.

2. Account Registration

• You must create an account to use BWChat.
• You are responsible for maintaining the confidentiality of your account credentials.
• You agree to provide accurate and complete information when creating your account.
• You are responsible for all activities that occur under your account.
• You must notify us immediately if you suspect unauthorized access to your account.

3. Acceptable Use

You agree not to use BWChat to:

• Send spam, unsolicited messages, or bulk communications
• Harass, bully, threaten, or intimidate other users
• Share illegal, harmful, abusive, or objectionable content
• Distribute malware, viruses, or other harmful code
• Impersonate another person or entity
• Attempt to gain unauthorized access to the Service or other users' accounts
• Use the Service for any illegal purpose
• Interfere with or disrupt the Service's infrastructure
• Scrape, crawl, or collect data from the Service without permission

4. User Content

You retain ownership of the content you create, upload, or share through BWChat ("User Content"). By using the Service, you grant us a limited, non-exclusive license to store, process, and transmit your User Content solely for the purpose of operating and providing the Service.

You are solely responsible for your User Content. We do not endorse or assume liability for any User Content posted by users.

5. Service Description

BWChat provides a messaging platform that allows users to:

• Send and receive text messages in real-time
• Share photos and videos
• Create and participate in group conversations
• Manage contacts and friend connections
• Customize user profiles
• Receive push notifications for new messages

6. Fees and Payments

BWChat offers a free plan and a paid subscription plan ("BWChat Pro"). Details of our current plans:

• Free Plan: $0 — core messaging features including 1:1 chat, limited group chats, and photo sharing.
• BWChat Pro: $2.99 USD per month (tax included) — includes unlimited group chats, video message sharing, extended media storage, priority message delivery, and priority customer support.
• Payments are processed securely through Stripe. We accept Visa, Mastercard, American Express, JCB, and other major credit cards.
• Pro subscriptions are billed monthly and automatically renew each month until cancelled by the subscriber.
• You agree to pay all applicable fees associated with your use of paid features.
• Prices are in USD. Pricing may be changed with prior notice to subscribers.

7. Refund Policy

We want you to be satisfied with your experience. Our refund policy is as follows:

• Subscription Services: If you are not satisfied with a paid subscription, you may request a refund within 7 days of your initial purchase. Refund requests after 7 days will be reviewed on a case-by-case basis.
• How to Request a Refund: Contact us at wegptcom@gmail.com with your account details and reason for the refund request.
• Processing Time: Approved refunds will be processed within 5-10 business days and credited back to the original payment method.
• Exceptions: Refunds may not be available if the account has violated these Terms of Service.

8. Intellectual Property

The Service, including its design, logos, software, and content (excluding User Content), is owned by BWChat and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service without our prior written consent.

9. Privacy

Your privacy is important to us. Our Privacy Policy describes how we collect, use, and protect your personal information. By using the Service, you consent to our data practices as described in the Privacy Policy.

10. Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms or engage in conduct that we determine is harmful to the Service or other users. You may also delete your account at any time by contacting us at wegptcom@gmail.com.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or secure. We are not responsible for any loss of data or content.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BWCHAT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless BWChat and its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your User Content, or your violation of these Terms.

14. Modifications to the Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We shall not be liable to you or any third party for any such modifications.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Japan.

17. Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall first be resolved through good-faith negotiation. If a dispute cannot be resolved through negotiation, the Tokyo District Court shall have exclusive jurisdiction of first instance.
